POPIA Statement
Introduction
This statement is in accordance with the Protection of Personal Information Act, 2013 (“POPIA”) and governs your interactions and business dealings with TBNSA (The Business Network South Africa)
In this statement, “Third Parties” include, but are not limited to; Operators, shareholders, subsidiaries, affiliated companies or joint ventures, suppliers, and parties providing products, goods, equipment, systems, and services, such as information technology.
“Personal Information” refers to any information or set of information that identifies a person and is processed by or on behalf of TBNSA , as described in Chapter 1, section 1 of POPIA.
Processing of Customer Personal Information
TBNSA may process customer Personal Information on its systems only in accordance with POPIA, where it has consent from customers, is necessary for the conclusion or performance of a contract, is part of an obligation imposed by law, protects a legitimate interest of a customer, or is necessary for pursuing the legitimate interests of TBNSA or a Third Party.
Distribution of Personal Information to Third Parties
TBNSA may provide access or transfer Personal Information to Third Parties when necessary for its business activities with customers or as required by law. TBNSA commits to taking reasonable steps to ensure confidentiality and compliance with legal requirements when transferring Personal Information to Third Parties.
Personal Information will only be transferred to Third Parties in other jurisdictions if they comply with privacy, data protection, and confidentiality laws, policies, or agreements required by law.
TBNSA may disclose customers’ Personal Information to Third Party service providers with necessary consent or in line with the contract between TBNSA and the customer. Agreements will be in place to ensure compliance with confidentiality and privacy conditions.
Undertakings with Third Parties aim to establish a mutual understanding regarding the protection of Personal Information, and Third Parties will be required to comply with regulations similar to those imposed on TBNSA.
Receiving Personal Information as a Third Party
As a hosting service reseller and/or provider, TBNSA may collect Personal Information from Third Parties. TBNSA will process this information in compliance with its terms and conditions and legislative requirements.
In its capacity as a Third Party, TBNSA will adhere to all obligations outlined in POPIA.
